Diane Utz, Owner/President

As a construction litigation attorney, Diane Utz has seen her share of major construction mishaps. Her experience has shown her, time and time again, that inadequately drafted contracts and poor communication are at the heart of nearly all of these problems. Reputable contractors love what they do, and do an excellent job, but many of them don’t recognize when an owner doesn’t understand what they are saying.

With an undergraduate degree in construction management from Purdue University, Diane spent the first ten years of her career working in estimating and boots-on-the-ground management roles on construction projects ranging from $1.5M–$125M. She was then recruited to be an in-house construction consultant for a law firm specializing in construction litigation where she spent five years working predominantly on construction defect claims. Gaining a detailed understanding of what can go wrong on a project and the results of poor construction, Diane decided to go back to law school to become a construction litigator.

Artemis Construction Management is our clients’ eyes and ears throughout the construction of their dream home or commercial building.

Diane realized the need for competent construction managers/owner's representatives during a three-week trial in Sun Valley, Idaho in which she successfully represented a contractor being sued by a homeowner for $3.8M. The homeowners in that case lived in Texas while building a home in Sun Valley. Although they started with the best intentions to manage the project from Texas, they quickly lost track of construction costs and finishes as they tended to their busy work lives. In the end, they lost at trial and had to pay Diane’s attorney fees associated with representing the contractor they sued.

That case was the impetus for Diane’s idea to combine her two careers into one as a construction manager/owner's representative. In this role, Diane utilizes her practical construction experience and ability to identify what can go wrong on a project to help owners successfully navigate often complicated pre-construction and construction processes. She founded Artemis Construction Management to offer home and commercial owners overall project coordination and management, as well as risk management services that provide the peace of mind that their dream home or commercial building will be built with minimal risk and full transparency of information.

In her spare time, Diane enjoys life in the Rocky Mountains including hiking, biking, skiing, and stand-up paddle boarding. Diane is also a construction arbitrator and serves within the leadership circle of the American Bar Association Forum on Construction Law, where she helps plan national conferences and edits books related to construction litigation.
